A. Product Information and Pricing
We strive to display as accurately as possible the colors, images, and descriptions of our products, such as the Aesthetic Desk Blotter with Floral Pattern for Home Office, featured products, and items listed under promotions like “Up to 15% Off” and “deal of the day.” We cannot guarantee that your computer monitor’s display of any color will be accurate. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction, and to limit the quantities of any products we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product made on this Site is void where prohibited.

OUR TOTAL LIABILITY TO YOU FOR ALL LOSSES, DAMAGES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST SIX (6) MONTHS FOR THE PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Eastern Stationery Mart Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
10. SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

We may terminate these Terms at any time without notice if, in our sole judgment, you fail to comply with any term or provision of these Terms. Upon termination, you must cease all use of the Site.
12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by final and binding arbitration administered by the ADR Institute of Canada, Inc. (ADRIC) in accordance with its Arbitration Rules. The place of arbitration shall be Brampton, Ontario. The language of the arbitration shall be English. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
